Abstract

Today, irregular migration has become one of the most important social phenomena that is at the top of countries' priorities, what is the absolute priority of States in their efforts to prevent illegal exits from national territories, because it is a complex social phenomenon in which many actors are involved (parent companies - host countries - networks active in this field), which led to its transformation into a legal phenomenon with a criminal dimension that crosses borders and nations.Perhaps the justifications for migration to safer and more stable countries include political, social and economic reasons that do not justify its transition from a social phenomenon to an international transnational crime, this has pushed countries to adopt policies and develop plans and strategies to combat this phenomenon at source or eliminate it downstream, in the form of inter or multilateral judicial cooperation agreements or security coordination at different levels, sometimes without taking into account the need to address the causes of this phenomenon or to provide guarantees to protect the rights of irregular migrants, far from the legal, judicial and security approach devoid of a human dimension in the management of this phenomenon.
