Abstract
يحاول هذا البحث أن يوضح التطور الذي حدث في شرط الصفة الرسمية لمرتكب جريمة التعذيب المتضمن في اتفاقية الأمم المتحدة لمناهضة التعذيب, وذلك من خلال أحكام القضاء الجنائي الدولي, خصوصا الأحكام الصادرة من المحكمتين الجنائيتين الدوليتين المتعلقتين بيوغسلافيا السابقة و رواندا. حيث إن الأحكام السابقة لهذا القضاء وضحت بأن الصفة الرسمية مطلوبة في جميع الحالات التي تتضمن جريمة التعذيب, أي سواء كان التعذيب جريمة دولية مستقلة أو جريمة حرب أو جريمة ضد الإنسانية, في حين أن الأحكام الحديثة لذلك القضاء لا تشترط تلك الصفة في كل الحالات, كما سيتضح من خلال هذا البحث.
