Estimating The Main Challenges Facing the Implementation of the FIDIC System in Construction Projects in Libya: "A Case Study on the Construction Projects in the City of Misurata"

Abstract

This paper aims to study the main difficulties and challenges faced when applying the FIDIC system in construction projects in Libya. To achieve this goal, a comprehensive study of FIDIC contracts was conducted, comparing them with the contracts derived from the administrative contract regulations implemented in Libya. The study also examined the feasibility of applying FIDIC in Libya, as well as the obstacles encountered in its implementation. In this context, a descriptive approach and mathematical analysis method were used by reviewing all the literature related to the administrative contract regulations and the Red Book, followed by the design of a questionnaire which was distributed to several target entities owning projects, including most of the legal entities that own and finance the projects currently being implemented. The study also covered a number of large local construction companies, targeting engineers and consultants within them. Their opinions were collected, examined, and analyzed to understand the feasibility of applying these terms, as well as to identify the administrative and legal difficulties they encountered through their practical experiences, offering a clear understanding of the obstacles and challenges. Personal interviews were also conducted with several heads of administrative bodies as decision-makers, as well as with legal offices within the targeted administrative entities.
